A Colorado Judge has caused an outcry by blocking a law that would have banned the controversial, “unproved and unethical” procedure. Here’s the whole story.
Preliminary Injunction Issued
A U.S. District Court Judge, Daniel D. Domenico, has recently issued a preliminary injunction against Colorado’s newly implemented ban on controversial “abortion reversal” procedures.
Colorado Governor Jared Polis signed the law in April. This decision to put a hold on implementing the ban follows a legal challenge by the Catholic healthcare center, Bella Health and Wellness.
Reproductive Rights Meet Religious Freedoms
Domenico heard arguments about Senate Bill 23-190, signed into law by Governor Polis. Bella Health and Wellness promptly challenged this law, contending that it impinges on their religious freedoms.
The recent ruling by Judge Domenico means that Colorado cannot prevent Bella Health and Wellness from providing “abortion reversal” procedures during the ongoing legal proceedings.
Anti Abortion as a “Religious Exercise”
An attorney representing Bella Health and Wellness emphasized, of course, the religious aspect of the matter in court last week, stating, “This [abortion reversal] is a religious exercise, and they have now banned the plaintiff’s religious exercise.”
Discrimination Against Whom?
The state, however, argued that the law should be subject to a rational basis standard rather than the stricter scrutiny standard of judicial review. The state asserted that the law was not discriminatory.
“Protect Unborn Life”
In his ruling, Judge Domenico sided with Bella Health and Wellness, stating, “There is no question whether Section Three burdens Bella Health’s free exercise of religion.
It does. Bella Health considers it a religious obligation to provide treatment for pregnant mothers and to protect unborn life if the mother seeks to stop or reverse an abortion.”
“Unproved and Unethical”
The topic of “abortion reversal” remains hugely controversial. While anti-abortion advocates maintain that it is a legitimate medical procedure, the American College of Obstetricians and Gynecologists takes a different stance, calling it “unproved and unethical.”
They also state that it has no scientific backing and has not been rigorously tested.
Misleading Claims
The unproven, unethical, and possibly dangerous procedure involves stopping a medication abortion that is already in progress by administering a high dose of progesterone after the patient has taken mifepristone, a medication used by women who wish to have an abortion.
The progesterone is claimed to counteract the mifepristone, but this has not been proven.
Appeal Possibilities
The state has 30 days to appeal Judge Domenico’s decision. The state has indicated that it will be appealing.

One such comment read, “We have a serious problem when people who have no medical education or understanding of any kind are making medical decisions for everyone. That leads to this kind of stupidity.”
“Religious Fantasy”
The same user continued, “There’s no such thing as an abortion reversal. It’s just another opportunity for religious fanatics to torment and demean women. Magical thinking is not fact, and we shouldn’t make policy around religious fantasy.”
“It’s The Mother’s Choice”
Another user online took a different view, posting, “I’m just not getting this. If people change their minds about abortion, they should be able to stop the abortion. That is what pro-choice is all about. It’s the mother’s choice.”
Religion Forced On Others
Other users, apparently not taken in by the “religious freedoms” argument put forward by Bella Health and Wellness’ lawyer, posted, “I think the point here is not whether or not abortion is wrong, but whether or not people should be allowed to force their religion on others by saying that the practice of their religion carries over to any service they offer to the public in general.”
Call Bill Nye
Another user took a firm stance on the scientific arguments against the procedure, posting, “Abortion reversals are fake, they have no medical relevance, and they don’t work. They should be banned since it’s not based on any science.”
